unconstitutional. how important is that? joining us is chris wallace. >> hey, guys. >> clayton: how big of a deal is it for the president? the first sort of stain on his second term so far, but there is a long history of presidents doing this, but when were the recess appointments put through, with an it really a recess? >> yeah, yes and he no. the suit was filed by a private businessman in washington state because he was unhappy with the decision by the national labor relations board and the national labor relations board needs three members and the president appointed three members in a recess appointment in january of 2011, but he did it at a time when the senate was holding these pro forma sessions every three days or so, knock the gavel and meet for 30 seconds and shut down, but they said that meant they weren't in recesses with these sessions and the businessman in washington said it wasn't a real recess and he filed suit. now, the court of appeals didn't say it was just because of that. they said in fact that the president can only announce a recess appointment during the tween s
